Terms of Use

These Terms of Use are an agreement between you and EverSterling Holdings LLC (“TechUpscale”, “we”, “us”), the operator of techupscale.com, its newsletters, RSS feeds and related services (together, the “Service”). By using the Service you agree to these Terms. If you do not agree, please do not use the Service.

1. Who may use the Service

The Service is intended for adults. You must be at least 13 years old to use it, and at least 16 to subscribe to our newsletters if you live in the European Economic Area or the United Kingdom. If you use the Service on behalf of an organisation, you confirm you are authorised to accept these Terms for it.

2. What TechUpscale is, and what it is not

  • News and information only. TechUpscale publishes news, summaries and analysis about technology, cybersecurity, artificial intelligence, business, policy, space and digital assets. Nothing on the Service is legal, financial, investment, tax, security or other professional advice, and nothing creates a professional relationship between you and us.
  • Security information. Our vulnerability alerts, advisories and lists summarise information published by government agencies, national cyber-security centres and vendors. Always confirm affected versions, fixes and deadlines in the original advisory, which each story links to, before acting.
  • Market data is not investment advice. Crypto prices (powered by CoinGecko), the stock ticker (provided by TradingView) and our market stories are for information only. They may be delayed, incomplete or wrong, and prices differ between exchanges. Do not rely on them to make trading or investment decisions. We do not recommend buying or selling any security or digital asset.
  • How our stories are produced. Many stories are drafted with the help of AI tools from primary sources and checked against those sources by automated verification and, where noted, by our editors, as described in our editorial standards. We work hard to be accurate, but errors can occur. If you spot one, tell us through our corrections policy.
  • Rankings. Our Top 10 lists are ranked by the rule stated on each list, using the data sources named there. They are not endorsements.

3. Our content and your permission to use it

The Service, including our text, headlines, summaries, graphics, story images, lists, design, logos and the TechUpscale name, is owned by TechUpscale or its licensors and is protected by copyright, trademark and other laws. Material we quote from others (for example government publications or company statements) belongs to its owners; US government works are generally in the public domain.

We give you a personal, non-exclusive, non-transferable, revocable permission to read the Service, share links to it, and quote short excerpts with credit to TechUpscale and a link to the original story. Use of our RSS feeds, including by other websites and apps, is governed by the republishing terms on our RSS Feeds & Republishing page, which form part of these Terms. Any other copying, republication, modification or distribution requires our written permission.

4. Things you may not do

  • Republish our articles in full, or remove or obscure credits, links or notices.
  • Scrape, crawl or bulk-download the Service, other than by standard search-engine indexing or our published RSS feeds used as those terms allow.
  • Use our content to train, fine-tune or evaluate artificial-intelligence models, or to build a competing news or data product, without a written license from us.
  • Interfere with or disrupt the Service, attempt to access accounts, systems or data that are not yours, probe for vulnerabilities without our permission (see section 11), or overload our servers.
  • Use the Service for anything unlawful, deceptive or harmful, or to impersonate TechUpscale or suggest that we endorse you.
  • Abuse our newsletter signup, for example by subscribing other people without their permission.

5. Newsletters and email

Our newsletters are free and sent only after you confirm your subscription. You can unsubscribe at any time with the link in every email. How we handle your information is described in our Privacy Policy, which forms part of these Terms. We may change, pause or stop any newsletter at any time.

6. What you send us

If you send us tips, corrections, comments, pitches or other material (“Submissions”), you confirm you have the right to share them, and you give us a non-exclusive, worldwide, royalty-free licence to use, edit, publish and adapt them in connection with the Service. We are not obliged to use any Submission. If you want your identity kept confidential, say so before you share information, so we can agree how we will handle it. Ordinary email is not a secure channel: please do not send confidential or sensitive information by email if its disclosure could harm you.

7. Advertising, sponsorship and affiliate links

The Service may show advertising, sponsored content and affiliate links. Advertisements are labelled “Advertisement”. Sponsored content is labelled with the sponsor’s name and is not written by our newsroom. Affiliate links, which may earn us a commission if you make a purchase, appear only in spaces labelled “Advertisement” or in content labelled as sponsored, never in our news stories. Advertising and sponsorship never influence our news coverage. Your dealings with advertisers are solely between you and them.

8. Third-party services, links and embeds

Stories link to their original sources and to other websites, and some features are provided by third parties (for example TradingView’s market widget and CoinGecko’s price data). We do not control those sites or services and are not responsible for their content, availability or practices. Their own terms and privacy policies apply.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS, OR THAT INFORMATION ON IT, INCLUDING SECURITY ADVISORIES AND MARKET DATA, IS CURRENT OR CORRECT. YOU USE THE SERVICE AT YOUR OWN RISK.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TECHUPSCALE AND ITS OWNERS, EDITORS, EMPLOYEES AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, INVESTMENTS OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED US DOLLARS (US$100). Some jurisdictions do not allow certain exclusions or limits, so some of these may not apply to you.

11. Security research

If you believe you have found a security vulnerability in the Service, please report it to info@techupscale.com (see also our security.txt). Do not access other people’s data, disrupt the Service, or publicly disclose the issue before we have had a reasonable chance to fix it.

12. Copyright complaints

If you believe material on the Service infringes your copyright, send a notice to info@techupscale.com with: your contact details; a description of the work; the URL of the material; a statement that you have a good-faith belief the use is not authorised; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorised to act for the owner; and your physical or electronic signature.

13. Indemnity

You agree to defend, indemnify and hold harmless TechUpscale and its owners, editors, employees and contractors from claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Service.

14. Changes, suspension and termination

We may change the Service, or these Terms, at any time. We will post changes here and update the date at the top; significant changes will take effect no sooner than 14 days after posting, except where required sooner by law. Continuing to use the Service after changes take effect means you accept them. We may suspend or block access to anyone who breaches these Terms.

15. Governing law and disputes

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws rules. Except where the law of your country or state gives you the right to bring proceedings where you live, any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in Fulton County, Georgia, and you and we consent to their jurisdiction.

16. General

These Terms, together with our Privacy Policy and the republishing terms on our RSS Feeds & Republishing page, are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms; we may transfer ours as part of a reorganisation, merger or sale. Nothing in these Terms creates any partnership, agency or employment relationship.
